Timesdaily.com - The family of a Tuscumbia woman killed in an automobile crash in September has filed a $5 million lawsuit against a Court Street business claiming workers allowed the driver to leave the business intoxicated. Tuscumbia attorney William Hovater filed the lawsuit Thursday in Lauderdale County Circuit Court against On The Rocks LLC, a restaurant/nightclub in Florence. Underwood, 25, a Deshler and University of Alabama graduate, was a passenger in the 1999 Chevrolet truck driven by her boyfriend, John Clark Burns Jr., 25, of Florence, when it crashed into a building in Cypress Inn, Tenn. Hovater said the lawsuit is filed under the Dram Shop Act, which stipulates an establishment cannot serve a visibly intoxicated person and can be held civilly liable for someone who leaves an establishment drunk.
