Restaurant sued after woman dies from oysters! |

WJHF.com - A Nashville, Tennessee man is suing a popular Panama City Beach restaurant over the death of his wife.
Bobbie Sovia died 13 days after eating a raw oyster. Her husband's attorney claimed the restaurant didn't properly warn the couple about the potential dangers. The Sovia's were vacationing at the beach in 2012. During their trip they ate a Dusty's Oyster Bar at least three times, consuming raw oysters. Bobbie reportedly ate one to two oysters on Tuesday, August 14th. The couple returned to the restaurant on Wednesday and Thursday, but their attorney claimed Bobbie did not eat anymore oysters. Over the next several days, her health began to decline. "She's not feeling that well on Thursday, she feels worse on Friday," Sovia's lawyer Elliot Olsen said. The Sovia' returned to Nashville where Bobbie was hospitalized.
She died on August 27. The autopsy found a bacteria infection called vibrio vulnificus, which is found in raw oysters. Continue |

Huffingtonpost.com - A 6-year veteran Wendy's worker in Alabama is alleging that management fired her for "job abandonment" while she was being treated for an ovarian cyst that would require surgery.
In a lawsuitfiled in federal court Friday, Jamila Richey accuses Wendy's of Bowling Green, Inc. of dropping her from the store schedule after two absences due to the cyst. According to Richey, she provided a doctor's note to prove she was sick and would have to be hospitalized.
Richey says in the lawsuit that she learned through coworkers that her manager "told everyone [she] had abandoned her job." After a series of meetings with managers, Richey alleges, she was told "she should not come back to work."
Mike O'Malley, the franchisee of the restaurant, said he had been unaware of the lawsuit or its allegations until contacted by HuffPost. O'Malley said he was concerned by the claims and would try to rectify the situation if they were true. Continue |
Couple kicked out of restaurant because of "Service dogs"! |

Clickorlando.com -A Florida couple says they were the subject of discrimination after they were kicked out of a restaurant because of their service dogs.
However, the restaurant is saying it is not that simple.
The couple says their Saturday morning breakfast turned into a nightmare. They say they both have disabilities that require them to have their morkie service dogs. A morkie is a Maltese-Yorkie mix. Police kicked the couple and their dogs out after a worker called 911 and said he did not believe the dogs were service animals.
A manager at the restaurant said she is retraining staff about the Americans With Disabilities Act. The couple plans to file a complaint with the Pinellas County Office of Human Rights and the U.S. Department of Justice. |

Local10.com - A state inspector found a major roach problem inside popular DiSalvo's Pizzeria in Hollywood last week, and frozen meat was found in a bathroom at Dragon 1 Chinese in Miami.
Records show five South Florida restaurants were ordered shut last week by inspectors with the Florida Department of Business and Professional Regulation.
Below is a list of the restaurants and some of their violations. All the places listed were allowed to re-open following an ordered clean up and re-inspection. continue |

Daninfo.com - "Cesspool" sludge and decaying mouse carcasses doomed the much-buzzed-aboutMission Chinese Foodrestaurant, according to a lawsuit filed by celebrity chefDanny Bowienand his partners against their former landlord.
The restaurateurs are demanding at least $500,000 from Abraham Noy, owner of 154 Orchard St., to make up for their lost profits and "immeasurable harm to their reputations and brand" after the restaurant was shut down twice by the Health Department and closed for good last year, court records show.
The lawsuit, filed July 31 inManhattan Supreme Court, accuses Noy of leasing Mission Chinese a space that was not up to code and then refusing to make repairs even though structural issues contributed to a rodent problem so severe that a "cesspool" of sludge and mouse corpses was discovered in a storage closet, according to the suit.
“As a result of these wrongful acts... [Mission Chinese] was forced to discontinue and abandon their use of the property," the suit says.
Noy's lawyer said his client denied the lawsuit's allegations, but declined to comment further. The lawyer for Mission Chinese declined to comment. Continue! |
Carolina Restaurant stops offering discount for praying! |

WFMYnews2.com -Mary's Gourmet Diner in Winston-Salem was offering discounts to some customers who prayed before eating their meal. After word of this got out, the restaurant has been getting national attention.
According to CNN's Headline News (HLN), this all started with a receipt posted to an Orlando radio station's website. Like most receipts, it showed the subtotal and then discounts. The discount listed was 15 percent for "praying in public."
Jordan Smith said she traveled to Winston-Salem for business and stopped for a meal there. She told HLN the group "prayed over our meal and the waitress came over at the end of the meal and said, 'Just so you know, we gave you a 15 percent discount for praying,' which I'd never seen before."
She posted it to her Facebook page and then a friend posted it to the radio station, where it took off. Continue |

Chicagotribune.com - Mount Prospect has agreed to a $6.5 million settlement that will end an unusual lawsuit filed by a restaurant owner who sued the village using a federal law more commonly used to bust organized crime.
The Village Board on Tuesday night approved the settlement with the owner of Ye Olde Town Inn, Tod Curtis, who has run the pizzeria for more than 40 years, said one of his lawyers, Riccardo DiMonte. Under the agreement, the village and its insurer will pay $6.5 million, $2 million of which will go toward attorney fees and legal costs. The village will pay $439,002 and an insurer will cover the rest, according to the agreement.
Curtis' lawsuit was noteworthy because he cited federal civil racketeering law in 2008 as he accused village officials and a local developer of trying to force him out of his downtown business to make way for a new development project. The lawsuit alleged the village and Oz Development LLC collaborated to try to push him out, violating the federal Racketeer Influenced and Corrupt Organization Act, known as RICO.

Sacbee.com -When California’s minimum wage jumped from $8 to $9 on July 1, owners of restaurants, coffee shops and bars braced for the fallout. They would either have to bump up prices and risk losing customers or absorb the hit and deal with slimmer margins.
Some had developed new cost-and-pricing strategies months ago to account for the 12.5-percent hourly increase, sprinkling in price hikes here and there throughout the menu so they wouldn’t be so noticeable to the consumer.
“We did it two-fold,” said Troy Paski, owner of Hoppy Brewing, a popular restaurant and brewpub in East Sacramento. “We addressed the issue early so there wouldn’t be so much sticker shock. Beer and liquor went up last November.Food priceswent up in April.”
“We hemmed and hawed about raising prices,” said Kimio Bazett, co-owner of Hook & Ladder and The Golden Bear, two busy midtown restaurant/bars that employ 84 people, half of whom earn minimum wage. Continue
