News-press.com - Clancey’s Restaurant could be going out of business because of free appetizer and buy-one-get-one-for-half-price coupons it sent out in 2006.

Bonnie Dewar, a retired mental health practitioner, said a junk fax from Clancey’s was one of many she received advertising services and goods she didn’t want or need. And for that, Dewar is suing Clancey’s for millions.

Dewar is the named plaintiff in four class action lawsuits, according to the Lee County Clerk of Court website, suing companies for violations of the Telephone Consumer Protection Act. Each violation (i.e. fax sent out) can cost a company $500 and as much as $1,500 if it’s determined to be “willful.” Multiply that by as many as 6,000 faxes a marketing firm sent out for Clancey’s, and it means at least a $3 million judgment.
